The seminar is presented by Jillian Stibbard, Partner at Baker love Lawyers and Family Law specialist.
It details the steps involved in a Family Law property settlement matter, and assesses whether or not attendees are able to make a property settlement application.
The steps covered in the seminar include:
-
Identify and value the Assets, Liabilities and Financial Resources and when and how they were acquired or arose.
-
Identify and assess the “contributions.”
-
What are the “future needs” of the parties?
-
Are the proposed orders “just and equitable”?
A Property Application Assessment is then covered which discovers who can make an application, circumstances which may be considered, and the threshold requirements.
The second half of the seminar details the issue of superannuation in a family law dispute and how it can be resolved by superannuation splitting. It begins with an explanation of superannuation splitting, which is where separating partners can value and split their superannuation payments.
It then goes on to show attendees how to value their superannuation, including the steps involved in requesting said value from superannuation fund trustees. Methods of splitting superannuation, including agreements and court orders are also covered.
